What to Look for in an Influencer Agreement Before You Sign

Most creators read the fee and skip the rest. The rest is where the problems live.

A brand deal agreement is not a formality. It is a document that defines what you are selling, for how long, and under what conditions. Creators who treat it as a formality occasionally discover, after the fact, that they sold more than they intended to for less than the work was worth.

The three clauses that matter most: and that get the least scrutiny: are exclusivity, usage rights, and revision rounds. Exclusivity defines which other brands you cannot work with during and after the campaign period. A 90-day exclusivity clause in a competitive category is not a minor inconvenience; it is a cap on other revenue that the fee must justify. Usage rights define where and for how long the brand can use your content. A post that runs as a paid ad for 12 months is worth significantly more than one that lives only on your feed for 30 days. Revision rounds define how many times the brand can request changes before they become billable. Without a defined limit, revision rounds can consume more time than the original creation.

Kill fees matter too. If a brand decides not to run the campaign after content has been created and approved, the creator has spent real time and should be compensated. Most standard agreements do not include kill fees unless the creator requests them.

None of this requires a lawyer for every deal. It requires the creator to read the agreement, know what standard terms look like, and be comfortable pushing back on clauses that do not work for their business. That comfort comes from repetition and from treating contracts as professional infrastructure rather than bureaucratic friction.
