How to Negotiate Your First Performance Deal (Step by Step)

Performance deals feel risky until you understand how to structure them. Here's how to negotiate your first one: from setting your floor rate to documenting the agreement.

Performance deals sound straightforward in principle: you get paid for results, not effort: but in practice, most creators negotiate their first one poorly because the variables aren't obvious until you've done it before. Rate floors, attribution methodology, milestone definitions, dispute clauses: these are the details that determine whether a performance deal is the most financially rewarding arrangement in your creator business or a frustrating race to a moving target. Here's how to approach the negotiation with clear eyes.

Step 1: Understand what you're agreeing to measure

Before you discuss rates, align on the measurement methodology. What counts as a conversion? A click? A signup? A paid purchase? Who tracks it, and how? The brand's tracking system, your tracking system, or a shared platform? Attribution windows: how long after a click does a conversion count as yours: matter enormously. A 24-hour attribution window and a 30-day attribution window on the same campaign can produce conversion counts that differ by a factor of three. Get this in writing before the rate conversation begins.

Step 2: Set a floor based on your known costs

Your floor rate in a performance deal should cover what a flat-fee deal would have paid you, divided by the number of conversions you're reasonably confident you'll drive. If you know from past campaigns that your audience converts at roughly 3% click-to-signup, and the content takes X hours to produce, you can calculate the minimum conversion volume needed to justify that time investment. Below that volume, you're subsidising the brand's campaign. Your floor is the rate at which the deal makes financial sense even in a below-average performance scenario.

A performance deal with no floor is not a performance deal: it's a speculative campaign where you absorb all the downside. Set the floor. Document it. Make it non-negotiable.

Step 3: Propose milestones, not just a rate

The most creator-friendly performance structure combines a base payment (which covers your production costs regardless of results) with performance bonuses that unlock when defined milestones are hit. Propose: a base fee paid on content delivery (non-refundable), plus a per-conversion rate for every verified result above a minimum threshold. This structure means you're never working entirely on speculation: and the brand is still aligned with your performance incentive.

Step 4: Negotiate the attribution window explicitly

If the brand uses a 7-day attribution window and you drive a signup on day 8 from a piece of content that was clearly responsible, you earn nothing for it. Attribution windows should be discussed, agreed, and documented before launch. For most creator campaigns, a 14–30 day window is reasonable and industry-standard. Anything shorter significantly disadvantages the creator, particularly for considered-purchase products where the decision cycle takes time.

Step 5: Document everything before a single piece of content goes live

A performance deal without a written agreement is a verbal understanding about money with someone you may barely know. The agreement should specify: the metric being measured, the rate per conversion, the attribution methodology and window, the base fee if any, the payment schedule, what happens in a tracking dispute, and the brand's obligations (keeping the tracking link active, not changing the landing page mid-campaign).
